Attorney general responds on same-sex marriage

Oregon Attorney General Ellen Rosenblum filed a brief responding to the federal marriage equality court case, saying the ban on same-sex marriage serves no rational purpose. The 43-page response was filed Tuesday in federal district court.
“In light of recent changes at the federal level, the refusal of Oregon to grant same-sex couples the right to marriage means that those couples are deprived of significant federal protections and benefits,” the brief says.
Upon analyzing the legal issues, the state defendants, which include Rosenblum, Governor John Kitzhaber, State Registrar Jennifer Woodward, the Center for Health Statistics and Multnomah County Assessor Randy Waldruff, found no satisfactory justification to defend the state’s ban on same-sex marriages.
The ban blocks those unions from federal benefits as well as full societal recognition and support of marriage, the brief says.
The brief said the defendants will remain as parties to the litigation and await the judicial determination. Until then, Oregon’s same-sex marriage ban will continue to be enforced.
