Stanford Lynn Overbay, aka Daniel Raymond Vice, 56, of 4745 Ash St., Astoria, was arrested April 1, 2002 by Officer Mike Baugher of the Seaside Police Department and charged with driving under the influence of intoxicants. On April 15, 2003, a jury found him guilty.

On April 26, 2003, Overbay was again arrested for DUII. This time, he told the arresting officer, Officer Brian Slotte of the Astoria Police Department, that his name was Daniel Raymond Vice, that he lived in Portland, and his date of birth was Aug. 11, 1952, making him 50 years old. His driver’s license showing this information had been issued May 2, 2000.

Three days later, on April 29, Overbay went to the Astoria Police Department, where he gave Sgt. Brad Johnston the paperwork relating to the April 26 DUII arrest and vehicle impound.

In court papers, Johnston states that, “it was apparent…(the person at the counter) was the person pictured on the license bearing the name Vice, Daniel Raymond.” Johnston further states that “the person at the counter…insisted that his name was Overbay” and couldn’t explain why the DUII paperwork listed the name of Vice. He also told Johnston that his date of birth was July 31, 1947, and that he had always gone by the name Overbay. When asked how the arresting officer had come up with the name Vice, Overbay said “he must have found the license.”

Johnston then arrested Overbay for giving false evidence to police. In a subsequent search of Overbay, Johnston found two wallets, each separated by name. One had identification for a Daniel Vice and a Janet Vice, a contract for rental property in the names of Daniel Vice, Stan Overbay and Janet Vice, and a social security card that “was obviously not a valid SSN card.” When asked to explain the documents, Overbay reportedly said that “he didn’t want to say anything else that would get him in trouble.”

Janet Vice, who was also at the counter of the Astoria Police Department, told Johnston that Daniel Vice was her deceased husband who died in 1973.

The Clatsop County District Attorney’s office filed charges of theft of identity (a felony), possession of a forged instrument (a felony), forgery-2, false application for driver’s license, giving false information to police, driving while suspended, and use of an invalid license against Overbay. On June 19, he was convicted of possession of a forged instrument and sentenced to 10 days’ jail, 18 months’ probation and ordered to pay court costs. He was also convicted of giving false information to police, for which he was sentenced to five days’ jail, 18 months’ probation and order to pay court costs. He was also convicted on the use of an invalid license charge and sentenced to five days’ jail, 18 months’ probation, a one-year driver’s license suspension and ordered to pay court costs. The other charges were dismissed.
